Epsilon.jpgKappa Delta’s Housing Contract grants a license to the resident to reside in Kappa Delta chapter housing. It is not a lease for a particular spot in the house, or a lease to live in the house. This distinction is legally very important and as such, the current recommended sample national housing contract makes that distinction quite clear with new license language. Please examine your current housing contract and make sure there is no language describing the contract as a lease, or referring to “subletting” or “renting” or tenant or anything that could be construed as granting a leasehold interest in the property. Depending on the state, this could subject the house corporation to the state landlord/tenant laws, which in some instances can be quite onerous. Hopefully, you have already distributed your contracts for this year and have your houses full so you will need to note this for your next contract season.
